ON LAND-USE TAX ADJUSTMENTS AND REDUCTIONS (Promulgated
by Shenzhen Minicipal People's
SUBJECT: TAXATION ISSUING-DEPT: SHENZHEN SPECIAL ECONOMIC ZONE ISSUE-DATE: 12/25/1984 IMPLEMENT-DATE: 01/01/1985 LENGTH: 1036 words TEXT: With a view to promoting the land development and utilization in Shenzhen Special Economic Zone so as to speed up its construction, and in accordance with the second section of Article 16 of the Provisional Regulations of Shenzhen Special Economic Zone on Land Control, which stipulates that "from the day when these regulations are made public, land use fees shall be readjusted once every three years", these measures are hereby formulated. [Article 1] The scale of fees stipulated in Article 16 of the Provisional Regulations of Shenzhen Special Economic Zone on Land Control is readjusted as follows: (1) For area of 1st category (including Luohu, Shangbu, Shekou Districts and the Town of Shatoujao), the scale of annual fees (RMB) per square metre of land shall be: 1. RMB 1.60 for industrial and warehouse use; 2. RMB 21.00 for commercial, guest house (hotel) and restaurant use; 3. RMB 9.00 for residential property development and hostels; 4. RMB 18.00 for tourist facilities (including land for buildings); 5. RMB 0.40 for outdoor recreation facilities; 6. RMB 0.70 for quarries, outdoor parking lots; 7. RMB 0.30 for plantation, animal husbandry, poultry raising and fish breeding. (2) For area of 2nd category (including Nantou District and Shahe Industrial District) the scale of annual fees (RMB) per square metre of land shall be: 1. RMB 1.30 for industrial and warehouse use; 2. RMB 17.00 for commercial, guest house (hotel) and restaurant use; 3. RMB 7.00 for residential property development and hostels; 4. RMB 15.00 for tourist facilities (including land for buildings) 5. RMB 0.40 for outdoor recreation facilities; 6. RMB 0.50 for quarries, outdoor parking lots; 7. RMB 0.30 for plantation, animal husbandry, poultry raising and fish breeding. (3) For area of 3rd category (area other than the 1st and 2nd categories), the scale of annual fees (RMB) per square metre of land shall be: 1. RMB 1.00 for industrial and warehouse use; 2. RMB 13.00 for commercial, guest house (hotel) and restaurant use; 3. RMB 5.00 for residential property development and hostels; 4. RMB 12.00 for tourist facilities (including land for buildings); 5. RMB 0.30 for outdoor recreation facilities; 6. RMB 0.40 for quarries, outdoor parking lots; 7. RMB 0.20 for plantation, animal husbandry, poultry raising and fish breeding. (4) For land for temporary uses, the annual fees per square metre is RMB 2.00. [Article 2] The methods of payment of land use fees as stipulated in article 18 of the Provisional Regulations of Shenzhen Special Economic Zone on Land Control have now been modified as follows: Land use fees shall be paid on an annual basis, and no interest on the fees will be calculated. [Article 3] The readjusted scale of fees stipulated herein does not include costs for land development and land requisition expenses. The land use fees shall be collected by the Tax Bureau of the Shenzhen Municipality. The costs for land development shall be calculated and recovered by the enterprises that have undertaken the land development. The expenses of land requisition shall be paid to the original land owners for resettling the original owners and paying them compensation. [Article 4] The preferential reduction and exemption of land use fees: (1) A 70-80% reduction in the scale of land use fees as stipulated herein shall be allowed to newly established enterprises within their construction period. The construction period for this purpose shall in general be two years for industrial projects starting from the day the land use permit is granted. In special cases extension may be allowed to enterprises that require a long period of capital construction. The construction period for all other trades shall be one year. (2) State-operated and collective-operated enterprises or undertakings established before the promulgation of the Regulations on Special Economic Zones in Guangdong Province on August 26, 1980 may be exempted from land use fees until the end of 1985 on land allotted to them before the promulgation of the regulations. In case the aforesaid enterprises and undertakings have, since the promulgation of the above-mentioned regulations, enlarged their land area or invested their land or factory buildings in joint ventures or co-operative ventures with foreign investment, land use fees shall be collected on such enlarged part of land or such original land. In case the aforesaid enterprises or undertakings that are eligible for the exemption of land use fees have already paid it, such paid-in amount shall be allowed to offset their fees payable from 1986 and on. (3) Land use fees are temporarily suspended on land used by state organs, army units, people's organizations or non-profit undertakings for cultural, propaganda, educational, scientific research, and public health and phisical cultural purposes, as well as on land for public utilities. (4) Land reclaimed from the sea by enterprises shall, upon obtaining of the land use permit, be exempted from land use fees for ten years. (5) With verification by the Science and Technology Development Centre of Shenzhen Municipality and by approval from Shenzhen Municipal People's Government, projects with up-to-date technology by world standards may, upon obtaining of land use permit, be exempted from land use fees for five years and allowed a 50% reduction in the rate of the fees for another three years. For projects with top level technology, land use fees may be totally exempted. (6) Enterprises established on donated capital from overseas Chinese and Hong Kong, Macao and Taiwan compatriots may, upon obtaining of land use permit, be exempted from land use fees for five years and allowed a 50% reduction in the rate of the fees thereafter. (7) Those that become practically unable to pay the land use fees due to force majeure or other special conditions may, upon approval by Shenzhen Municipal People's Government, be allowed a postponement or a reduction or exemption of the fees for that year. [Article 5] These measures shall come into effect on January 1, 1985. |
